We recently had a client, who was a law enforcement officer and who was injured in a motor vehicle accident. He inquired what benefits were available to him. If a law enforcement officer or first responder is injured in a motor vehicle or third-party action, they may have, in addition to a workers’ compensation claim, a third-party claim against the insured motorist or third-party responsible for the injury. How this works is workers’ compensation is required to provide medical and indemnity benefits through workers’ compensation, and there may be a separate third-party claim against the insured at-fault individual or entity.
